A franchise allows a business to grow its brand through independently owned outlets, using a proven system, shared know-how and a recognised trade mark. For franchisees, it offers a route into business ownership with the support of an established brand.
Franchising in South Africa is regulated by the Consumer Protection Act and its regulations, which prescribe the content of franchise agreements, require a disclosure document to be given at least 14 days before signing, and give franchisees a 10-business-day cooling-off period. Competition law, trade mark law and general contract law also apply.
We advise franchisors and franchisees on building, documenting, buying into and protecting franchise systems, and on resolving franchise disputes when relationships break down. Read more about our franchise lawyers.
