The Commission for Conciliation, Mediation and Arbitration (CCMA) resolves most workplace disputes under the Labour Relations Act. Strict time limits apply, and preparation at conciliation and arbitration often decides the outcome.
An unfair dismissal dispute must be referred within 30 days of the dismissal. An unfair labour practice dispute must be referred within 90 days. Late referrals require an application for condonation.
If a dismissal is unfair, the CCMA can order reinstatement, re-employment or compensation of up to 12 months’ remuneration, or up to 24 months for automatically unfair dismissals heard by the Labour Court.
Legal representation at arbitration in conduct and capacity dismissals is allowed only by agreement or with the commissioner’s permission. We prepare your case and witnesses either way.
We help employers and employees prepare for conciliation and arbitration and resolve disputes on the best available terms.
